Delhi Master Plan 2047: What It Means for Housing
PoA and Will are two of the most misunderstood legal documents in property matters. Here’s a clear, practical explanation of the key differences and when you should use each.
Many people in Delhi NCR get confused between Power of Attorney (PoA) and a Will, especially when planning property matters. While both are important legal documents, they serve completely different purposes.
At Avorix Realty, we regularly advise clients in Noida, Gurgaon, and Janakpuri on these documents. Understanding the difference can save you from costly legal mistakes later.
A Power of Attorney is a legal document that lets you authorise someone you trust to act on your behalf for specific matters — usually while you are alive. For property, this could mean signing documents, renting out your flat, or handling bank work. It becomes invalid after your death.
A Will is a document that states how you want your assets distributed after your death. It only comes into effect once you pass away. You can change or cancel it anytime during your lifetime.
| Aspect | Power of Attorney (PoA) | Will |
|---|---|---|
| Purpose | Manage affairs while alive | Distribute assets after death |
| Validity | Ends on death or revocation | Activates after death |
| Property Transfer | Cannot transfer ownership | Can transfer ownership to heirs |
| Registration | Mandatory for property matters | Optional but recommended |
Use a PoA when you’re travelling abroad or unable to handle matters personally — very common among NRIs in Delhi NCR. Use a Will to ensure your property goes to the right people after you. We often advise clients to have both in place for complete peace of mind.
Always get a PoA registered if it involves property. For Wills, registration makes execution smoother. Before any major property decision, calculate potential costs and returns using our Stamp Duty Calculator and ROI Calculator.
